REPORTING OF AGRICULTURAL AND FOOD PRODUCTS

Agricultural producers, depositaries, processers, and retailers in the Romanian agro-food sector are bound to monthly reporting of the stocks of agricultural food products to the Ministry of Agriculture and Rural Development, under the new Law no. 105/2023, published in the Official Journal no. 321 of April 18, 2023.

Scope

The Law no. 105/2023 is mandatory for all economic operators in the agro-food sector, except for retailers running sale structures of 400 sqm or less (excluding storage, keeping and production of goods, office premises and annexes).

The law does not apply to street vendors, vendors providing public food services or those carrying out marketing activities in public areas.

The economic operators in the agro-food sector aimed at by this law are bound to provide statistical data on the stocks of agro-food products only once a month, until the 15th of the month for the preceding month.

The agro-food products concerned are listed in the schedule of the law. Among these products there are: vegetables - fruits, cereals and cereal-based products, milk and milk products, milling and bakery products, honey, sugar, rice or processed, processed, preserved products from fruits – vegetables.

The Ministry of Agriculture and Rural Development will develop and implement a software for collection of the statistic data reported by the economic agents and will centralize such data, by protecting confidentiality thereof. The government will approve the methodological norms issued by the Ministry of Agriculture and Rural Development and the Ministry of Finances within the 90 days since entering into force of the law, namely on July 20, 2023.

Sanctions

Incompliance with the legal provisions is deemed contravention and is sanctioned with a fine ranging between 5,000 Lei and 20,000 lei.
